1. Agreement to Terms
By accessing or using Cogo Site (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our services. These Terms constitute a legally binding agreement between you and Cogo Site.
2. Service Description
Cogo Site provides an AI-powered website builder platform that enables users to create, customize, publish, and manage websites. The Service includes website editing tools, hosting, custom domain support, AI content generation, and related features as described on our platform.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information when creating an account. You must be at least 13 years old to use this Service. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Acceptable Use
You agree not to use our services to: create websites containing illegal content, infringe on intellectual property rights, distribute malware or engage in phishing, engage in fraud or deceptive practices, send unsolicited bulk communications (spam), violate any applicable laws or regulations, attempt to gain unauthorized access to our systems, or interfere with the proper functioning of the Service. We reserve the right to remove content that violates these guidelines without prior notice.
5. User Content and Intellectual Property
You retain full ownership of all content you create using our platform. By using our services, you grant us a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of providing our services. We do not claim ownership of your websites, text, images, or other content. Our platform, templates, AI models, and design assets are owned by Cogo Site and protected by international copyright, trademark, and other intellectual property laws.
6. Payment and Billing
Paid plans are billed on a recurring basis (monthly or annually). You authorize us to charge your payment method for the applicable fees. All payments are processed through our payment processor Waffo Pancake, a Merchant of Record — you agree to their terms of service for payment processing. Prices may change with 30 days' advance notice. Refunds are available within 7 days of purchase under our 7-day money-back guarantee, provided the service has not been substantially used. Credits purchases are non-refundable once used.
7. Subscription and Cancellation
You may cancel your subscription at any time through your account dashboard. Upon cancellation: your subscription remains active until the end of the current billing period, you retain access to your content and can export it, after the billing period ends your sites will revert to free-tier limitations. We may terminate your access for violation of these Terms — upon termination, your right to use paid features ceases immediately.
8. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for temporary unavailability caused by factors beyond our control, including network outages, infrastructure failures, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Cogo Site shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, including loss of data, revenue, or business opportunities. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, original, or suitable for your specific needs.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, available at https://cogosite.com/privacy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
12. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance via email or in-app notification. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service before the effective date.
